Compliance and risk

Your agency runs the creator deals. Your company is liable for every post.

Basa puts every creator deal your company signs, from every agency and every office, on one record you control. Whether it is signed, what the creator was told, who approved it, when the rights end and what was paid is on the record before anyone outside the company asks.

Today

One creator deal lives in six places today. Your company often sees none of them.

Ten years ago this was 10 deals a month. Now it is a thousand, on the same budget, through the same process. The agency holds the thread, the spreadsheet and the PDF. When a client or an auditor finds the gap, it is already too late.

Hi Maya, the brand loved the pitch. One reel and two stories, $4,500?
4,500 works. What about usage?

Has finance paid? It’s been six weeks.
Checking.
One deal, six places: text threads, email, a spreadsheet, a DM, a PDF and the agency’s inbox. Multiply by a thousand deals, six agencies and every office.
Who pays

You can outsource the work. You cannot outsource the liability.

When a post breaks the rules, the letter goes to the company whose product was promoted, whoever ran the deal and whoever posted it. The law calls that company the advertiser, and it says so in every market: the FTC in the US, the CMA in the UK, the Consumer Affairs Agency in Japan, the KFTC in Korea, CONAR in Brazil.

The liability stays here
Brand
Pays for the post. Named in the regulator's order and in the lawsuit.

Agency
Finds, negotiates, briefs and pays. Keeps the deal in its own inbox.

Creator
Posts. Agrees terms by DM. Pays the smallest fine, if any.
Bud Light
US revenue down 10.5% in Q2 2023 as Bud Light volumes fell during a boycott.
Anheuser-Busch results, Aug 2023
Teami
$1 million, and an FTC order to review every paid creator post.

Kroger
Sony alleges 392 unlicensed song uses in Kroger and paid-creator posts. The case is pending.

How Basa does it

Know every creator deal before it becomes a problem.

Basa takes the deal out of text threads, email, spreadsheets and PDFs and puts it on one record you control, whichever office or agency did it. Any agreement in two clicks. Your agencies keep working the way they do.

Every deal shows whether it is signed, by whom, and which version.
Terms that break your rules reach legal before the deal is sent.
Rights end dates sit on every deal. Filter to next month.
What any office paid any creator is on the record before the next offer.
Signing runs through your DocuSign account. The signed copy stays on the record.

Keep every agreement your company signs with a creator.

Your templates, your e-signature, your agencies. One record, and the brand owns it.

Basa is software for keeping and applying the terms your legal and compliance teams set. It is not legal advice. Headlines and figures on this page are public; allegations are described as allegations.
Six questions to ask your marketing team this week
1How many creator deals did we and our agencies close last quarter?
2Where is the signed agreement for each one?
3What were the creators told to disclose, and who told them?
4Who approved each post before it went live?
5Which creator content is still running in paid media, and when do those rights end?
6If a regulator wrote to us tomorrow, how many days would it take to produce all of this?
If any answer is "I'd have to ask the agency," the record is not yours.
